TEXmenu Program License Agreement, Pricing and Ways of Distribution CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS. LICENSING AND USING TEXMENU INDICATES YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS. LICENSE 1) The group of persons allowed to use the program is determined by the type of license mentioned in the program's Info Panel: Individual license: The person mentioned in the Info Panel is allowed to use this software on as many machines as he/she has access to. Nobody else is allowed to use the program except the program was transferred to another person following the terms stated in 2). Site license: Every person is allowed to use this program on every machine within this site with a site license. Demo/Unregistered version: Every person is allowed to use this program in demo-mode on every machine. The demo version may (and ought to) be duplicated and transferred to other persons/machines as you like. You are not allowed to offer your registration key to other persons except as stated in 2) and 3). 2) You may transfer the registered program with an individual license to another person if the other person agrees to accept the terms and conditions of this agreement. If you transfer the program, you must either transfer all copies to the same person, or, destroy any copies not transferred. Furthermore you are not allowed to use this program any more and you have to inform Harald Schlangmann via email or letter about the change of ownership. 3) A site license limits the number of machines the program may be copied and used on, to a special number. If your site expands to a number of machines larger than that the site was licensed for, you must expand the site license also. If a user of the site wants to use this program on a machine not within this site he/she must register individually. 4) You're not allowed to modified the TeXmenu distribution. You're not allowed to represent TeXmenu as a product of any person or company except Harald Schlangmann. YOU MAY NOT USE, COPY, MODIFY, OR TRANSFER THE PROGRAM, OR ANY COPY, MODIFICATION OR MERGED PORTION OF THE PROGRAM, IN WHOLE OR IN PART, EXCEPT AS EXPRESSLY PROVIDED FOR IN THIS LICENSE. IF YOU TRANSFER POSSESSION TO ANOTHER PARTY, YOUR LICENSE IS AUTOMATICALLY TERMINATED. LIMITATION OF REMEDIES Harald Schlangmann's entire liability, and exclusive remedy shall be: 1) The replacement of damaged diskettes returned to Harald Schlangmann, or a re-send via email when distributed this way. 2) If Harald Schlangmann is unable to deliver a replacement diskette (or the program via email) which is free of defects in materials or workmanship, you may terminate the agreement by returning the diskette, and your money will be refunded. IN NO EVENT WILL HARALD SCHLANGMANN BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR THE INABILITY TO USE SUCH PROGRAM. DISTRIBUTION There are at least three ways to receive a copy of the program: 1) You take a copy from the Internet e.g. via anonymous ftp from ftp.informatik.uni-muenchen.de or a mail server, 3) you take a copy from some CD-ROM (almost always outdated), 2) you register as described below and send an additional charge for shipping and floppy disk. To get a license (register) you send the following particulars to H. Schlangmann: Kind of license: Site license (plus max. number of machines), individual license or individual license for students. Name, institution, address, email address, phone. Additionally for site licenses the number of machines and contact information. For convenience TeXmenu contains a registration form in menu item Info->Registration Form... Payment is accepted as check (preferred), money order or cash (on your own risk). After sending the above data and money, you will receive a registration card containing the registration key. If you have email access you will get an additional note via this. PRICING (English) 1) Upgrading any TeXmenu 3.x version to TeXmenu version 5.0pre is 50% of the respective price in 2). Upgrades from any TeXmenu 4.x version to TeXmenu version 5.0 is free. License keys are available immediately. 2) First time TeXmenu 5.0pre registration: Individual license: 50 US$ Individual license for students: 25 US$ Site license (1-10 machines): 185 US$ (11-25 machines): 350 US$ (26-50 machines): 600 US$ (51-100 machines): 1000 US$ (unlimited): 1400 US$ NB: Add 5 US$ if you want to receive a floppy disk. Special discounts for multiple individual license orders (standard and student, provided number is greater equal 3) are available. Group orders are Individual license: 40 US$ Individual license for students: 20 US$ each. The easiest and cheapest way to pay from the United States or Canada is sending a personal check. FUTURE DEVELOPMENT AND SUPPORT In this release TeXmenu supports the architectures m68k, i386, hppa and sparc. Further upgrades and a final 5.0 release are planed. Black hardware will be supported at least as long as NeXT does with its OS. ADDITIONAL NOTES If you think this software is not worth paying, don't use it! It is that decent priced that almost everybody will be able to pay it. If you want to see further versions register now! Having priced TeXmenu that low, I depend on your fairness!
